You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use only. THE TRAVISON TRAIL SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TRAVISON TRAIL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Travison Trail does not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service or the servers that make it available are free of viruses or other harmful components. We do not warrant or make any representations regarding the use or the results of the use of the Service in terms of its correctness, accuracy, reliability, or otherwise.

We make no representations or warranties about the accuracy, completeness, or suitability of any travel information, recommendations, or content provided through the Service. 8. Limitation of Liability

Unauthorized access, use, or alteration of your transmissions or content

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

IN NO EVENT SHALL TRAVISON TRAIL'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TRAVISON TRAIL IN THE LAST SIX (6) MONTHS, OR, IF GREATER, ONE HUNDRED DOLLARS ($100).

9. Indemnification

You agree to defend, indemnify, and hold harmless Travison Trail, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

Your violation of these Terms of Service
Your use of the Service, including but not limited to your User Content
Your violation of any rights of another person or entity
Your violation of any applicable laws, rules, or regulations

We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with us in asserting any available defenses.

10. Termination

We may terminate or suspend your account and access to the Travison Trail Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease, and you must cease all use of the Service.

You may terminate your account at any time by contacting us at the email address provided in the Contact Information section below. Upon termination of your account, we may delete your User Content and account information, although some information may remain in our backup systems or archives.

All provisions of these Terms which by their nature should survive termination shall survive termination, including without limitation ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law and Dispute Resolution

These Terms of Service and any dispute or claim arising out of or related to these Terms or the Service shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Delaware, and the parties irrevocably consent to the personal jurisdiction and venue therein. You waive any objection to jurisdiction and venue in such courts.

If you have any dispute with Travison Trail, you agree to first contact us and attempt to resolve the dispute informally by sending a written notice to the contact information provided below. We will attempt to resolve the dispute informally by contacting you via email. If a dispute is not resolved within thirty (30) days of submission, you or Travison Trail may bring a formal proceeding.

12. Changes to Terms

Travison Trail reserves the right to modify or replace these Terms of Service at any time at our sole discretion. If we make material changes to these Terms, we will notify you by posting the new Terms on travisontrail.com and updating the "Effective Date" at the top of this page. We may also provide notice through email or through a notice on our homepage.

Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service. It is your responsibility to check these Terms periodically for changes. We recommend that you review these Terms whenever you access the Service.

13. Miscellaneous

These Terms of Service constitute the entire agreement between you and Travison Trail regarding the use of the Service and supersede all prior agreements and understandings, whether written or oral.
